Terms of Service
These Terms of Service ("Terms") govern your use of the Taybo iOS app ("Taybo", "the app", "we", "our"). By downloading, installing, or using Taybo, you agree to these Terms. If you do not agree, do not use the app.
1. Description of Service
Taybo is a calorie and nutrition tracking app that allows you to log food intake, set nutrition goals, scan barcodes, and use an AI-powered assistant for natural language food logging. The app stores data locally on your device with optional iCloud sync.
2. Acceptable Use
You agree to use Taybo only for its intended purpose of personal nutrition and calorie tracking. You agree not to:
- Use the app for any unlawful purpose or in violation of any applicable laws
- Attempt to reverse-engineer, decompile, or disassemble the app or its services
- Attempt to gain unauthorized access to our servers, proxy services, or other infrastructure
- Abuse, overload, or interfere with the app's AI assistant or API services
- Use automated tools, bots, or scripts to interact with the app or its services
- Redistribute, resell, or sublicense the app or any content obtained through it
- Submit intentionally false, misleading, or malicious input to the AI assistant
- Use the app on behalf of a third party without their consent
We reserve the right to suspend or terminate access to the app or its services if you violate these Terms.
3. AI Assistant — Limitations and Disclaimer
Taybo includes an AI-powered assistant that uses OpenAI to help you log food and get nutrition suggestions. By using this feature, you acknowledge and agree that:
- AI responses are estimates, not facts. Calorie counts, macro breakdowns, and food suggestions generated by the AI are approximate and may be inaccurate. Always verify nutrition information against packaging labels or authoritative databases when accuracy matters.
- The AI may make mistakes. It may misinterpret your input, return incorrect portion sizes, confuse similar foods, or produce nonsensical results. You are responsible for reviewing and correcting any AI-generated entries before relying on them.
- AI output is not personalized advice. Suggestions are generic and do not account for your full medical history, allergies, intolerances, or dietary needs beyond what you explicitly provide.
- Availability is not guaranteed. The AI assistant depends on third-party services (OpenAI) and may be unavailable, slow, or degraded at any time without notice.
- Your input is processed by OpenAI. Messages you send to the AI assistant are transmitted to OpenAI for processing. See our Privacy Policy for details on what data is shared and your privacy controls.
4. No Medical or Health Advice
Taybo is a nutrition tracking tool, not a medical device or health service. Nothing in the app constitutes medical advice, diagnosis, or treatment.
- Consult a professional. Always consult a qualified healthcare provider, registered dietitian, or physician before making changes to your diet, especially if you have a medical condition, eating disorder, food allergies, or are pregnant or nursing.
- Not a substitute for professional care. Calorie goals, macro targets, and BMR calculations provided by the app are general estimates based on standard formulas. They are not tailored medical recommendations.
- HealthKit data is informational only. Health metrics displayed from Apple HealthKit (calories burned, steps, weight) are for informational purposes and should not be used to make medical decisions.
- No emergency use. The app is not designed for emergency situations. If you have a medical emergency, contact your local emergency services.
You use the app's nutrition information and recommendations entirely at your own risk.
5. Subscription Terms
Free and Paid Features
Taybo may offer both free features and premium features available through a paid subscription. Specific features included in each tier are described on the App Store listing and within the app.
Billing and Renewal
- Subscriptions are billed through Apple's App Store and are subject to Apple's terms and policies
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate
Managing Your Subscription
- You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions
- Cancellation takes effect at the end of the current billing period — you retain access to premium features until then
- We cannot process refunds directly; all refund requests must go through Apple Support
Free Trials
- If a free trial is offered, it converts to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends
- Unused portions of a free trial are forfeited when you purchase a subscription
Price Changes
We may change subscription prices at any time. Price changes take effect at the start of the next billing period following notice. Continued use after a price change constitutes acceptance of the new price.
6. Intellectual Property
The app, its design, code, content, and branding are owned by us and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes in accordance with these Terms.
Food nutrition data sourced from the USDA database and Open Food Facts is used under their respective public domain and open data licenses.
7. User Content
You retain ownership of any content you create in the app, including custom foods, recipes, and food log entries. By using iCloud sync, you authorize us to store and transmit your content through Apple's CloudKit service solely for the purpose of syncing your data across your devices.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- The app is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the app will be uninterrupted, error-free, secure, or free of viruses or harmful components, or that nutrition data will be accurate or complete.
- In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or health-related damages arising from your use of or inability to use the app.
- Our total aggregate liability for any claims arising from or related to these Terms or your use of the app shall not exceed the amount you paid for the app in the twelve (12) months preceding the claim, or fifty US dollars (USD $50), whichever is greater.
- We are not liable for any actions you take based on information provided by the app, including AI-generated content, nutrition estimates, or calorie calculations.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the app, your violation of these Terms, or your violation of any third-party rights.
10. Third-Party Services
The app integrates with third-party services (OpenAI, Open Food Facts, Apple CloudKit, Apple HealthKit). These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.
11. Termination
We may suspend or terminate your access to the app or its services at any time, with or without cause, and with or without notice. Upon termination, your right to use the app ceases immediately. Sections 4, 8, 9, and 12 survive termination.
You may stop using the app at any time. Deleting the app removes all local data. If you have an account, you can delete it and all associated data from Settings > Delete Account.
12. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the United States and the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the app shall be resolved in the courts located in New York, New York.
13. Changes to These Terms
We may update these Terms from time to time. Changes will be reflected in the "Last Updated" date above. Continued use of the app after changes constitutes acceptance of the updated Terms. If we make material changes, we will notify you through the app or other reasonable means.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.
